By placing an order with Calculedge ("we," "us," "our"), you ("Customer") agree to be bound by these Terms of Service in their entirety. If you do not agree to these terms, do not place an order. These Terms constitute a legally binding agreement between you and the individual operator of Calculedge. Calculedge is a sole proprietor operation and is not incorporated as a legal entity.
Calculedge sells digital calculator programs written in TI-Basic for use on Texas Instruments TI-84 Plus CE and TI-84 Plus calculators ("Programs") and custom study notes ("Notes"). All Products are delivered electronically via email. No physical goods are shipped. Programs are sold as-is and are intended as productivity tools to assist with mathematical computation.
Calculedge Programs and Notes are computational and educational tools only. We make no representation, warranty, or guarantee that use of any Product will result in improved grades, test scores, academic performance, or any other educational outcome. Results depend entirely on the Customer's own knowledge, effort, and application of the tools provided.
It is the Customer's sole and exclusive responsibility to determine whether the use of any Calculedge Program or Notes is permitted by their school, teacher, course syllabus, exam proctor, or examination authority (including but not limited to College Board, ACT, IB, state testing agencies, and individual institutions). Calculedge does not represent that its Products are authorized for use in any specific exam, course, or academic context. Calculedge expressly disclaims all liability for any academic integrity violations, honor code violations, disciplinary actions, exam invalidations, grade penalties, suspensions, expulsions, or any other consequences arising from the Customer's use of Products in an academic setting. By purchasing, you acknowledge that you have checked with your relevant academic authority and accept full responsibility for how and when you use the Products.
Because all Products are digital files delivered electronically, all sales are final and Calculedge does not offer monetary refunds under any circumstances, including but not limited to: dissatisfaction with the product, accidental purchase, or change of mind. However, Calculedge is committed to making sure every customer is happy with their program. If your program has a bug, doesn't work as described, or you have questions about installation or usage, contact us within 72 hours of delivery and we will fix it, update it, or walk you through it at no additional charge. We stand behind our work.
Programs and Notes are delivered by email within 24 hours of confirmed payment. "Confirmed payment" means receipt of cleared funds via Stripe. Rush Delivery is prioritized and typically fulfilled the same day, subject to availability. Delivery time estimates are not guarantees. Calculedge is not liable for delays caused by email delivery failures, spam filters, incorrect email addresses provided by the Customer, or circumstances outside our control.
Upon purchase, Calculedge grants you a limited, non-exclusive, non-transferable, personal license to install and use the purchased Program on your own TI-84 Plus CE calculator(s) and to use the purchased Notes for your own personal study. You may not: (a) redistribute, resell, sublicense, or share any Product with others; (b) post any Product publicly online; (c) represent any Product as your own work; (d) use any Product for commercial purposes. Violation of these restrictions may result in termination of your license without refund.
All Programs, Notes, source code, and related materials are the intellectual property of Calculedge and its operator. Purchase of a Product does not transfer ownership of the underlying content. Calculedge retains all copyright and intellectual property rights.
Every Program delivered by Calculedge is personalized with the Customer's name and a unique license ID embedded in the program's startup screen. This information is tied to the individual purchase and is non-transferable. Sharing a personalized Program with any third party constitutes a violation of these Terms and may constitute copyright infringement.
Custom orders are subject to operator availability and scope assessment. Calculedge reserves the right to decline any custom request. Custom Products are built to the specifications provided by the Customer at the time of order. Changes requested after development has begun may incur additional charges. The same no-refund policy applies to custom orders. Calculedge retains the right to incorporate techniques, logic, or components from custom builds into future general-release products.
PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CALCULEDGE DOES NOT WARRANT THAT PROGRAMS WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL CALCULATOR FIRMWARE VERSIONS OR CONFIGURATIONS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CALCULEDGE AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF ACADEMIC STANDING, LOSS OF REVENUE, OR ANY OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Calculedge and its operator from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of any Product in violation of these Terms; (b) any academic integrity violation or disciplinary proceeding resulting from your use of a Product; (c) your violation of any applicable law; or (d) any misrepresentation made by you in connection with an order.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
In the event of a dispute, you agree to first contact Calculedge directly and attempt to resolve the matter informally before initiating any formal proceeding. For any dispute where the amount in controversy is less than $10,000, you agree to resolve the matter through binding individual arbitration administered by a mutually agreed-upon arbitrator, rather than in court. Class action participation is waived.
Calculedge reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our services after changes are posted constitutes acceptance.
